General Terms of Use

KISANI is a marketing, multi-brand promotion and loyalty program operated by KISANI SARL (referred to as "KISANI" or "we"). KISANI allows its users to obtain discounts and rebates after purchase from companies, merchants and stores that use its services. 

These general conditions ("Conditions", "Agreement") constitute an agreement between the user and KISANI ("Company", "We", "Our"). This Agreement sets out the general conditions of the use of the KISANI loyalty program and any of its associated services (collectively, the "Services").

In these Terms of Use, the following words and expressions shall have the meanings given to them below:

Customer: means any person who participates in the Program.

Membership Card: means the card issued to Customers that, when activated, provides access to the majority of Merchants in the Program.

Means of Access: means a membership card, or code, customer ID or other form of access provided by KISANI.

Merchant: means a third party provider of services, including but not limited to restaurants, spas, retail stores, grocery stores, hotels, lounges, or third party platforms, that are available to customers participating in the Program.

Referring Merchant: means the organization responsible for processing customer payments for merchant access through the Program, including but not limited to KISANI affiliates.

Program: means the KISANI Program designed to allow the customer to access merchant discounts and offers.

Terms of Use: By participating in the Program, the customer agrees to these Terms of Use. These Terms of Use will supersede any other terms and conditions provided to the customer in connection with the purchase or use of the Program. KISANI reserves the right to make changes to these Terms of Use at any time. The customer agrees that KISANI may provide notice by posting the Terms of Use on the Program website and application, and that the customer’s use of the Program constitutes agreement to the current Terms of Use. Customers are advised to review these Terms of Use before using the Program.

Third Party Organizations: Customer must comply with the rules and policies of each participating merchant, and Customer agrees that providing a means of access for a merchant does not guarantee access or continued access and is subject to capacity restrictions. Customer agrees that KISANI has no control over the merchant’s decision to admit or not a customer, the number of people allowed to enter at any time, the facilities offered, opening/closing hours, or the length of time customers may spend in the lounge. KISANI will use reasonable efforts to ensure that benefits and facilities are available as advertised, but Customer agrees that KISANI makes no warranty that any or all benefits and facilities will be available at the time of Customer’s visit.

Payments Between Customer and Merchant: Any access or purchase may require payment in addition to the customer’s fee. This additional payment is managed by the Merchant and KISANI accepts no responsibility for this transaction between the Customer and the Merchant.

Third Party Links and Websites: The Program Website may contain links to websites, offers or programs operated or owned by third parties that are not part of or controlled by KISANI. KISANI accepts no responsibility for the content of these third party websites, or for any Merchant’s use of these third party websites or the redemption of any third party offers. KISANI will not be liable for any loss or damage that may arise from the Customer’s use of third party websites, offers or programs.

Personal Data: By participating in the Program, the Customer consents to the use of their personal data in accordance with the policies Privacy Policy of the Program.

Discount Offer: refers to restaurant, spa and retail offers generally characterized by a discount offered by a merchant to the customer, the merchant being the merchant of record (the customer pays the merchant directly); generally, discounts financed by the merchant (discount or % off).

USER ELIGIBILITY

To open a KISANI account you must be at least 18 years old and you must obtain the authorization of your parents or legal guardian to register on KISANI if you are under 18 years old. KISANI may change its eligibility requirements at any time, and reserves the right to refuse membership to any applicant, in its sole discretion.

USE

To participate in the KISANI loyalty program, you must create an account on our platform and provide accurate, complete and current information. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your account.

You will also be asked to create a 4-digit security code that you will need to log in and in certain cases when using the application. This 4-digit security code is strictly personal and confidential. You must not disclose it to anyone without any reason whatsoever. By logging into the KISANI application, you certify that all registration information you have provided during registration and throughout your interactions with KISANI is true and accurate. You agree to update your registration information as necessary to maintain its truthfulness and accuracy.

You are responsible for all transactions related to your KISANI account. You are required to maintain the confidentiality of the security code. In addition, by completing your registration and logging into KISANI you accept the General Terms of Use presented below and you consent to our sharing your registration information with partner KISANI Stores. You can complete your registration by:

- Going to one of the KISANI Partner Stores

- Downloading the KISANI application on your mobile device

- Contacting our customer service center at contact@kisani.co

REGISTRATION

You cannot use KISANI services without first registering on the client mobile application. Go to the Apple Store or the Google Play Store to download the KISANI  application and then register.

USER CONSENT

By registering on the KISANI application, the User is deemed to have read and accepted these terms and regulations, and declares to be bound by them.

The mere fact of downloading the KISANI application implies the User's pure, simple and unreserved acceptance of the services defined in these Terms of Use.

Under no circumstances shall the Company, its directors, administrators, employees or agents be held liable for any indirect, incidental, special, consequential or punitive damages, including, without limitation, loss of profits, data, use, customers or other intangible losses, arising from or in connection with your use of the Services.

CONDITIONS FOR OBTAINING DISCOUNTS

Discounts are granted to each merchant according to a percentage or offer negotiated in advance between the merchant and KISANI. Both Companies reserve the right to modify the value of the discount percentage at any time and without notice.

CONDITIONS FOR OBTAINING POINTS

Points are earned through eligible transactions, as indicated in the KISANI loyalty program guidelines. The Company reserves the right to change the reward structure at any time and without notice.

Points have no monetary value and cannot be exchanged for cash. Points are also not transferable.

Points can be exchanged for rewards, as described in the KISANI program guidelines. The availability of rewards may vary and is subject to change without notice.

The Company reserves the right to modify or terminate the available reward options at any time.

PROTECTION OF PERSONAL DATA

Your privacy is important to us. Please refer to our Privacy Policy for more information on how we collect, use and disclose your personal information.

We collect information that you provide when you:

- fill out forms

- communicate with us

- answer one of our surveys

- register to use the KISANI app

- open an account or use one of our services

- participate in online discussions or promotions

- chat with a member of our social media or customer support teams

- enter a competition or share information with us on social media or contact us for any other reason

We will collect the following information:

- your name, address and date of birth

- your email address, telephone number and information about the device used (for example, your phone, computer or tablet)

- your KISANI username, known as your “KISANI Client ID” (this is random and is automatically assigned to you when you first register)

- your registration information

- copies of your identification documents (for example, your ID or your driving license) and any other information you provide to prove your eligibility for our services

- recordings of our discussions, if you contact us or if we contact you (including recordings of telephone calls)

- your image in the form of a photo or video, and facial analysis data extracted from your photo or video to verify your identity during registration as part of our customer identity checks

- technical information, including IP address

- the type of mobile browser you use

- information about transactions and your use of KISANI products

- information about your location

Occasionally, we use publicly available information about you from certain social media websites or applications to carry out enhanced due diligence checks. Publicly available information from social media websites or applications may also be provided to us when we conduct general searches about you (for example, to comply with our anti-money laundering or sanctions screening obligations).

We collect information and contact details from publicly available sources, such as news articles, online registries or directories and websites, for enhanced due diligence checks, security research and KYC purposes.

Legal obligations:

- Market and offer products and services that may be of interest to you

- Personalise your in-app experience and our marketing messages about our products and services so that they are more relevant and interesting to you (where permitted by law). This may involve analyzing how you use our products, services and your transactions

- Legitimate interests (to target direct marketing mailings, ensure our direct marketing is relevant to your interests, develop our products and services, and be effective in how we fulfill our legal and contractual obligations)

- Consent (where we are legally required to if you agree, provide you with information about our partners' offers or promotions that may be of interest to you if you agree, allow our partners and other organisations to provide you with information about their products and services ask for your opinion about our products or services Remember, you can ask us to stop sending you marketing information by changing your choices.

How do you use my personal data for marketing purposes?

If you register for our services, and where national laws allow it, we will assume that you want us to contact you by post, push notification, email, Whatsapp and SMS with information about KISANI products, services, offers and promotions. Where national laws require us to obtain your consent to send marketing messages, we will ask you for this in advance.

We use your personal data to personalize marketing messages about our products and services so that they are more relevant and interesting to you (where permitted by law). This may include analyzing how you use our services and your transactions.

You can change your preferences or inform us that you no longer wish to receive direct marketing at any time.

If you do not wish to receive personalized marketing messages and you opt out, you will not receive any marketing communications. However, you can still receive generic information about our products and services in the KISANI app.

FEEDBACK

If you have not received your discount or offer, please contact KISANI Support through the KISANI mobile application (indicating that you made a payment at one of the KISANI Partners Stores but that your discount was not taken into account) or at the email address contact@kisani.co.
